California Man Could Face Vehicular Manslaughter Charges in Daughters' Death

A California man could be facing manslaughter charges, if the recommendation of the California Highway Patrol are followed. He was recently behind the wheel of his SUV when it struck a police cruiser and flipped, resulting in the deaths of his two daughters who were passengers in the SUV. According to reports, he had fallen asleep at the wheel, which is what led to the accident. The family was returning home after having been up for over 24 hours.

Although the CHP has recommended that manslaughter charges be filed against the driver, prosecutors have not yet decided whether or not to file charges, and he has not been arrested at this time.

Manslaughter is essentially the unlawful killing of another without malice. It is generally broken down into two distinct categories, voluntary and involuntary. Voluntary manslaughter often occurs as the result of an argument or in the heat of passion. There may even be the intent to cause physical harm, but not the intent to kill. Involuntary manslaughter, on the other hand, often occurs when the death is caused by the alleged perpetrator breaking the law or being negligent.

A conviction of manslaughter could result in a variety of fines, probation or prison, depending upon the individual circumstance.

It remains to be seen what will happen in the case of the California man whose daughters were killed.
